Website Terms of Use

True Human Mark LLC · Last updated: October 2026

These Terms are an interim version published during the pilot program and are under review by legal counsel. They may be updated, and each version will show its date.

1. Acceptance of These Terms

These Website Terms of Use ("Terms") govern access to and use of the websites, public verification records, application interfaces, and related online services (together, the "Website") operated by True Human Mark LLC, an Indiana domestic limited liability company ("the Company"). By accessing or using the Website, a user agrees to these Terms.

Who may use the Website. Anyone may browse public pages and verification records. To create an account or apply for certification, a person must be at least 18 years old.

Applicants, subscribers, and badge licensees. Anyone who creates an account, applies for certification, subscribes, or displays a badge or label must also accept, by an affirmative click or checkbox, the applicant agreement and badge license the Company provides before an application is submitted. The Company records the version accepted and the date and time of acceptance. These Terms do not replace those agreements; if they conflict, those agreements control the matters they cover.

A user who does not agree to these Terms should not use the Website.

2. Informational Nature of the Website

Information presented on the Website describes the Company's certification program in general terms and does not itself constitute certification of any specific work. Certification exists only when the Company issues a certification record for a specific work and identified edition, consistent with the Company's then-current certification criteria.

3. Public Verification Records

A user may look up the Company's public verification records on the Website. A user should rely on the current status displayed by the Company for a given certification record, together with the limitations stated in that record, rather than on a badge image alone or on a cached or archived copy of a page.

4. Accounts and Access

Where the Website offers applicant or subscriber accounts:

Account holders must provide accurate, current information and keep it up to date.

An account is for the named individual or for an organization's designated authorized users. Credentials may not be shared with anyone else.

Account holders are responsible for keeping credentials secure and for activity under their account, and must promptly report suspected unauthorized access to [email protected].

The Company may require multi-factor authentication or a password change.

The Company may temporarily restrict an account when reasonably necessary to protect records, evidence, applicants, or Website security (Section 16).

Closing an account does not by itself change the status of a certified work.

5. Prohibited Conduct

A user of the Website may not:

Attempt to bypass security measures or access restricted evidence.

Interfere with the operation of the Website.

Submit false information or impersonate another person.

Scrape confidential or restricted information from the Website.

Use the Company's marks in a misleading manner.

Manipulate, or attempt to manipulate, certification records or verification links.

Upload malicious code, or upload material the user has no right to submit.

Use automated tools in a way that overloads the Website or bypasses its access limits, other than ordinary search-engine indexing of public pages.

Harass or threaten others, or submit knowingly false complaints.

6. Badge, Mark, and Verification-Link Misuse

No one may use a Company badge, label, or mark except as permitted by the Company's written badge license. Without limiting that license, no one may:

Copy a badge onto an uncertified work, or onto a different edition or version of a certified work.

Alter a badge or label, including its wording, colors, shape, proportions, certification ID, or serial number.

Redirect, remove, or disguise a verification link.

Display an expired, suspended, revoked, or replaced badge as current.

Suggest that a badge certifies an author, publication, or website generally, or that the Company endorses a publication, its opinions, or its products.

Remove required limitations or status information, or create a look-alike badge or label.

The Company may update the public record, notify the host of the misuse, and take other appropriate steps.

7. Intellectual Property

The Company owns or licenses the Website, its marks (including the True Human Mark name; Penvera is a working name for the planned certification mark), badge and label designs, software, text, and other Company materials, except for third-party materials and materials owned by users or applicants. No license to any of the foregoing is granted except as expressly stated in these Terms or in a separate written agreement, such as the Company's badge license.

Names and marks. "True Human Mark" is the Company's name and brand. Penvera is a working name for the planned certification mark. It is pending clearance and filing, and badge artwork using it is draft only. The classification badges and the AI Made disclosure label are controlled by the Company.

No license through browsing. General Website access grants no right to use any badge, certification mark, logo, seal, or label. Badge use is permitted only under the applicable written license and only for the certified work and edition identified in the certification record.

Feedback. If a user sends suggestions about the Website or program, the Company may use them without obligation to the user.

8. Applicant Materials and Uploads

Use of the Website, by itself, does not transfer ownership of any applicant's materials to the Company. Applicant materials submitted with a certification application are handled under the applicant agreement and the Company's privacy practices, not under these Terms.

Uploads. By uploading materials, an applicant confirms that it has the right to do so and grants the Company a limited, non-exclusive license to store, copy, and review them only to administer the application, the certification record, complaints, appeals, and legal obligations. Uploaded materials are confidential and are not published, except for the approved fields shown in a public verification record.

9. Copyright Complaints

A person who believes material on the Website infringes their copyright may send a written notice to [email protected]. The notice should include the information required by 17 U.S.C. § 512(c)(3): a physical or electronic signature; identification of the copyrighted work; identification and location of the material claimed to infringe; contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that the sender is authorized to act for the copyright owner.

The Company may remove or disable access to material that is the subject of a notice and, in appropriate circumstances, close the accounts of repeat infringers. A user whose material is removed may send a counter-notice as the law allows.

10. Third-Party Services and Links

The Website relies on third-party providers, which may include website hosting and analytics (GoDaddy), email and file storage providers, and, when paid services begin, a payment processor. The Website may also link to other websites. The Company does not control those services or sites and is not responsible for their separate terms, availability, or privacy practices, but it remains responsible for its own obligations under applicable law. Payments are handled by the payment processor, and the Company does not intend to store full payment-card numbers.

11. Website Availability and Security

The Company aims to keep the Website, verification lookup, and application portal available, but it does not guarantee continuous, uninterrupted, or error-free operation. The Company may restrict access temporarily for maintenance, security, investigation, or legal compliance.

Backup status check. If the verification lookup is unavailable, anyone may confirm the current status of a certification by emailing [email protected] with the certification ID or serial number.

The Company uses reasonable security measures, but no website can be guaranteed free of vulnerabilities or interruptions.

12. Certification Limitations

The Company does not guarantee that all AI use can be detected, that submitted evidence cannot be fabricated, or that a certification decision establishes copyright ownership, originality, factual accuracy, legality, or literary quality of any certified work.

A certification reflects the Company's certification criteria and the evidence available at the time of review. It is not legal advice or a copyright determination. It does not guarantee truthfulness, factual accuracy, the absence of all AI assistance, or future compliance, and readers, publishers, and others remain responsible for their own decisions.

13. Disclaimers and Limitation of Liability

Except as expressly stated in these Terms or a signed agreement, the Website and its content are provided "as is" and "as available," and, to the extent permitted by law, the Company disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits a right that cannot be limited under applicable law.

To the extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Website, including Website interruptions, reliance on a public record, unauthorized copying of a badge, or third-party misconduct. The liability of applicants and subscribers is governed by their separate agreements.

14. Indemnification

A user who misuses a badge, label, or verification link, submits false information, or violates another person's rights through the Website agrees, to the extent permitted by law, to cover the Company's reasonable losses and costs from third-party claims caused by that conduct.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Before filing a claim, a user and the Company agree to try to resolve the dispute informally for 30 days after one party gives the other written notice describing it.

If the dispute is not resolved, it may be brought only in the state courts located in Hancock County, Indiana, or in the United States District Court for the Southern District of Indiana, and the parties consent to the jurisdiction of those courts. These Terms do not require arbitration.

Sections 6, 7, 9, and 12 through 15 continue to apply after a user stops using the Website.

16. Suspension and Termination

The Company may restrict Website access, disable an account, suspend a verification link, correct an inaccurate public record, preserve evidence, or cooperate with a lawful investigation when reasonably necessary to protect the program, the public, or the Website.

Losing Website access does not by itself change the status of a certified work. Changes to certification status follow the Company's certification procedures, including their notice and appeal rights. A user may stop using the Website at any time and may close an account by contacting the Company.

17. Accessibility

The Company aims to make the Website usable by people with disabilities, including accessible headings, form labels, keyboard navigation, text alternatives for images, adequate contrast, and clear error messages. To request assistance or report an accessibility problem, including with an application or complaint, email [email protected]. The Company will offer a reasonable alternative, such as a scheduled call.

18. Changes to These Terms and Contact

The Company may update these Terms. Each version will show its date. Material changes that affect account holders, applicants, or badge licensees will be sent to the account email address, or communicated in another reasonable way, before they take effect. Changes do not retroactively alter an existing certification agreement unless that agreement allows it.
